These Terms of Service ("Terms") govern your use of UnFlocked ("Service"), operated by UnFlocked LLC ("we," "us," or "our"). By accessing or using our Service you agree to be bound by these Terms. If you disagree with any part of these Terms, do not use our Service.
1. About the Service
UnFlocked is a privacy tool that provides a map of publicly reported Automated License Plate Reader (ALPR) camera locations and route planning features. UnFlocked is an independent privacy tool and is not affiliated with, endorsed by, or connected to Flock Safety or any other surveillance company in any way.
Camera location data is crowdsourced from public sources and is provided for informational purposes only. We do not guarantee the accuracy, completeness, or currency of any camera location data.
2. Acceptable Use and Prohibited Uses
UnFlocked is a lawful privacy and informational tool intended for drivers who wish to understand surveillance infrastructure on public roads and exercise their legal right to choose their own routes. You agree to use UnFlocked only for lawful purposes consistent with this intent.
You expressly agree NOT to use UnFlocked to:
- Facilitate, plan, assist, or conceal any criminal activity of any kind
- Evade law enforcement detection in connection with any unlawful act
- Stalk, surveil, or monitor any individual without their consent
- Reverse engineer, scrape, copy, or redistribute our camera database for any commercial purpose
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Submit false, fabricated, or intentionally misleading camera location reports
- Use the Service in any way that violates applicable local, state, or federal law
- Use the Service on behalf of any third party without their knowledge or consent
UnFlocked LLC reserves the right to suspend or terminate access to any user we reasonably believe is using the Service in violation of these terms or for any unlawful purpose, without notice or refund.
Lawful use clarification: Choosing your own driving route, including routes that avoid certain roads or intersections, is entirely lawful. UnFlocked helps you make informed routing decisions — the same way navigation apps help drivers avoid tolls, traffic, or speed cameras. We do not condone or support any use of this Service in furtherance of criminal activity.
3. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
UnFlocked LLC specifically does not warrant that:
- Camera location data is accurate, complete, current, or free from errors — data is crowdsourced and may be outdated, incomplete, or incorrect
- Privacy routes will avoid all ALPR cameras — new cameras may have been installed after data was last updated
- Use of the Service will achieve any particular privacy or security outcome
- The Service will be available, uninterrupted, or error-free at all times
- Any defects or errors in the Service will be corrected
- The Service is free from viruses or other harmful components
Camera data is crowdsourced from public sources and is for informational purposes only. Do not rely solely on UnFlocked data for any safety-critical, legal, or security decision. Always drive safely and obey all applicable traffic laws. UnFlocked is a privacy information tool, not a law enforcement countermeasure.
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNFLOCKED LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, business, or goodwill
- Personal injury or property damage of any nature
- Unauthorized access to or alteration of your data
- Any damages resulting from inaccurate or incomplete camera location data
- Any damages resulting from your reliance on route suggestions or surveillance scores
- Any conduct or content of any third party using the Service
THESE LIMITATIONS APPLY WHETHER OR NOT UNFLOCKED LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE).
Our total aggregate liability to you for any and all claims arising from or related to these Terms or the Service shall not exceed the greater of: (a) the total amount you paid to UnFlocked LLC in the twelve (12) months immediately preceding the claim, or (b) ten dollars ($10.00 USD).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
5. Subscriptions and Payments
UnFlocked offers a free tier and a paid Pro subscription. By subscribing to Pro you agree to the following:
- Subscription fees are billed monthly or annually as selected at checkout
- Payments are processed by Stripe and are subject to Stripe's terms
- Subscriptions automatically renew unless cancelled before the renewal date
- You may cancel your subscription at any time from your account settings
- Refunds are provided at our discretion within 7 days of initial purchase
- We reserve the right to change pricing with 30 days notice to subscribers
6. Intellectual Property
The UnFlocked name, logo, website design, and original content are owned by UnFlocked LLC. You may not use our name, logo, or branding without our written permission.
Camera location data contributed by users remains in the public domain. By submitting a camera location you grant us a perpetual, irrevocable license to use that data within the Service.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
7b. No Legal Advice
Nothing in the Service or on unflocked.org constitutes legal advice. Information about state ALPR laws, your rights, or law enforcement practices is provided for general informational purposes only and may not reflect the most current legal developments. Consult a licensed attorney in your jurisdiction for legal guidance specific to your situation.
8. Indemnification
You agree to indemnify and hold harmless UnFlocked LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.
9. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms. You may stop using the Service at any time. Upon termination of a paid subscription, you retain access through the end of your current billing period.
10. Governing Law
These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Michigan.
11. Changes to Terms
We may update these Terms from time to time. We will notify paying subscribers of material changes by email at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
